20 July 2021Italian Supreme Court, Civil Section I, Order no. 19187/21 lodged on 06/07/2021, stated that, in the context of an advance transaction on invoices settled in a current account, actual failure by the bank to re-credit the customer’s ordinary current account with the amounts collected from the third party, debtor of its customer, and failure by the bank to use it to extinguish previous account holder’s liabilities, constitutes an “anomalous” way of extinguishing the obligation entailing a cause for revocation under art. 67, paragraph 1, no. 2 of the Insolvency Law.
