Interest and monetary revaluation on non-privileged claims in the compulsory administrative liquidation

Italian Supreme Court, Civil Division, 09/06/2021, no. 16084. Presiding Judge Spirit, Reporting Judge Torrice; the Court affirmed that in the procedure of compulsory administrative liquidation, by virtue of articles 55 and 201 of the Insolvency Law and of art. 83, paragraph 2, of legislative decree no. 385 of 1993, the calculation of interest and monetary revaluation on claims not assisted by privilege must cease at the date of the measure that, by ordering the liquidation, initiates the concurrence of creditors.
